Ideally, in the United States, you are innocent until proven guilty. That’s the law and our Constitutional right, but if we followed this, bail would be a non-issue. Here’s why: most people that pay bail have not been convicted, therefore they are innocent, until proven guilty. So, why the need to pay a bail when you are innocent and have not been deemed guilty by a Judge or Jury?
Many say that bail is meant to keep the alleged defendant from fleeing. If a citizen cannot afford bail, how can they possibly flee to another state or even another country? Further, this bail is returned once the defendant is cleared or exonerated. Bail is unnecessary and legal representation, unencumbered by heavy caseloads and poor government policy, is necessary. In addition to 2.3 million people being incarcerating, an additional 7 million Americans are on probation, another revenue generator for government. Our Legal Defense Initiative will work to remove the barriers that exist to legal defense.
We categorically believe in safe communities, accountability, law and order and public safety. In areas where freedom is compromised and sentences are unjust, the Legal Defense Initiative is ready to intervene and bring the injustice to the attention of citizens, the government, Judicial canons and the criminal justice appeals system. We’re spending $182 Billion a year on a criminal justice system that is clearly failing.
